Portable Appliance Testing laws are covered by four main Health and Safety legislations. These PAT testing laws are of specific relevance to electrical maintenance, and ensure safety at work. It is imperative that these Portable Appliance Testing laws are followed and checks are made regularly to keep up to date with current changes to any related legislation.
Portable Appliance Testing laws are included in the following legislations:
o Electricity at Work Regulations 1989
o Health & Safety at Work Act 1974
o Provision and Use of Work Equipment Regulations (PUWER)1998
o Management of Health & Safety at Work Regulations 1999
The Portable Appliance Testing laws which are involved with the Electricity at Work Regulations 1989 ensures that an inspection is carried out on any electrical equipment in a work environment. The Electricity at Work Regulations 1989 applies to all electrical equipment used in or associated with places of work.
“As may be necessary to prevent danger, all systems shall be maintained so as to prevent, so far as reasonably practicable, such danger”
“‘Electrical Equipment’ includes anything used, intended to be used or installed for use, to generate, provide, transmit, transform, rectify, convert, conduct, distribute, control, store, measure or use electrical energy.”
The PAT test laws which are included in the Health and Safety at Work Act 1974 state that the premises should be made and kept safe. A PAT test will ensure the building is safe and not posing any dangers. This is the duty of the employer and all employees.
The Management of Health and Safety at Work Regulations 1999 relate to PAT test laws because this legislation ensures that all health and safety risks are depleted. This legislation states that:
“Every employer shall make suitable and sufficient assessment of:
(a) the risks to employees which exposed to whilst at work, and
(b) the risks to ensure the health and safety of persons not in his employment arising out of or in connection with the conduct by him or his undertaking”
Portable Appliance Testing laws associated with PUWER 1998 ensure preventative measures are taken to cover most risks that can happen in a place of work. PUWER 1998 only applies to work equipment used by workers at work including equipment connected to an electrical energy source.
“Every employer shall ensure that work equipment is maintained in an efficient state, in efficient working order and in good repair.”
